The Bribery Act 2010, effective from 01 July 2011 has significant implications for all organisations. As well as individual offences of offering, requesting or receiving a bribe, it creates the corporate offence of “failing to prevent bribery”. Under the Act an organisation is liable for the actions of any person carrying out services for or on its behalf, in whatever capacity. This covers contractors, agents, subsidiary companies and other third parties.

The only defence available is that “adequate procedures” had been put in place to prevent bribery.

This highly participative half-day workshop provides an overview of the act and what it means including the “adequate procedures” that organisations should put in place to protect themselves.

The session can be extended to include the development of anti-bribery policies and procedures, or risk assessment of key business processes.

The workshop can also be combined with our Fraud Risk Management workshop to give full coverage of the fraud and bribery risks facing an organisation.

The Bribery Act places a considerable onus yon our organisation and the managers in it. As well as reputational damage, organisations may be subject to large fines, and individuals may be imprisoned and disqualified from directorship.

Putting reasonable procedures in place to prevent bribery is a now requirement for all organisations.
